‘Ingredients of marriage lacking’ – Mansa magistrate dissolves loveless marriage

THE Mansa Local Court has dissolved a marriage of a 24 year old businessman of Kabulo Village in Chief Kambwali’s Chiefdom in Nchelenge District for irreconcilable differences.

Before Mansa Local Court Magistrates Leontina Zaloumsi and David Mubanga was Holland Chiluba who summoned his wife Dorothy Kapindula also of Kabulo Village in Chief Kambwali’s chiefdom for divorce on grounds of suspected infidelity.

Chiluba is also seeking for compensation from Webster Simwanda 35 a teacher in Nchelenge who is alleged to have an affair with his wife.

ZANIS reports that during trial Chiluba told the Court that trouble started when his wife left their matrimonial home after some differences and went to live with her relatives and refused to reconcile following numerous efforts.

In cross examination, Kapindula told the court that her husband was abusive towards her and was going back to the woman he had a child with before they got married, hence her reason to refuse him conjugal rights and eventually leaving her matrimonial home.

But Chiluba contended that his wife upon leaving their matrimonial home did start to engage in an extramarital affair with Simwanda.

In passing Judgement, Local Court Magistrate Zaloumsi stated that in view of the overwhelming ingredients that could not sustain a marriage, the court deemed it fit to dissolve the marriage without compensation from either parties but asked Chiluba to be remitting child support of K200 every month.

And Local Court Magistrate David Mubanga said even though there was no evidence to show that Simwanda had slept with Kapindula, he should be charged to compensate Chiluba and since slapped him with K3,000 to be paid in monthly instalments of K300 for circumstantial adultery.

Magistrate Mubanga said he was disappointed with Simwanda’s behaviour since he was a teacher who is supposed to be role model in society.
